These punishments have goals. The holy law of Islam and Western law are no exception. Although according to some, it is not possible to combine these goals in punishments, but it is possible in terms of prioritization and in terms of importance, and this important thing has been achieved by the Shari'a to such an extent that more than any other goal, punishment Society and support for the realization of restorative justice is given priority over other goals. در هر جامعه ای قانون گذار برای برقراری نظم و حفظ حیات اجتماعی مجازات هایی را درنظر گرفته که ضمانت اجرای وضع مقررات هر جامعه است .این مجازات ها اهدافی را با خود به دنبال دارند. شریعت مقدس اسلام و حقوق غربی نیز از این امر مستثناء نیستند. به طور کلی چهار هدف برای تمامی مجازات های قانونی یا قراردادی متصورند که عبارتند از : 1- سزادهی 2- بازدارندگی 3- بازپروری 4- ناتوان سازی . دراین مقاله با روش تحلیلی توصیفی به بررسی تطبیقی این چهارهدف درحقوق غربی و اسلامی پرداخته شده است . هدف از این پژوهش روشن ساختن زوایای تاریک علل کیفردهی در ذهن بشر است که با بررسی این اهداف از مفهوم تا کارکرد، به حکمت های وضع مجازات ها و اجرای آن و امتیازات ویژه آنها دراسلام نزدیک شده و درنتیجه آمادگی ذهنی برای تمکین در مقابل مقرارات کیفری اسلام را بیشتر فراهم می آورد. از میان اهداف فوق الذکر سزادهی هدفی است گذشته نگر که به آینده توجه ندارد بنابراین وظیفه گراست و سه هدف دیگر اهدافی آینده نگر هستند که به گذشته توجهی ندارند و فایده گرا هستند. اگرچه به زعم برخی تجمیع این اهداف در کیفرها ممکن نیست اما به صورت اولویت بندی و با لحاظ ترتیب اهمیت ممکن بوده و این مهم را شریعت تا حد زیادی محقق ساخته به گونه ای که بیش از هر هدفی، سزادهی را که ضامن تحقق عدالت کیفری در جامعه و پشتیبان تحقق عدالت ترمیمی است نسبت به سایر اهداف اولویت بخشیده است. http://www.aeclrjournal.ir/article_118096_d1f86b3c8c863e8f83326600f148374d.pdf
