چکیده

عملیات حفظ صلح ملل متحد به عنوان ارکان فرعی شورای امنیت از مزایا و مصونیت ملل متحد برخوردار است. در برخی از مأموریت ها گزارش هایی از نقض حقوق بشر و بشر دوستانه توسط نیروهای حافظ صلح به گوش می رسد، اما مصونیت آنان مانع از تعقیب کیفری در دادگاه دولت میزبان می باشد و تنها دادگاه صالح برای رسیدگی به جرایم این نیروها، علاوه بر دادگاه ملی دولت فرستنده، دیوان کیفری بین المللی می تواند باشد. هرچند در دیوان کیفری بین المللی، مصونیت مانع از رسیدگی نمی شود، اما این دیوان هم در رسیدگی به جرایم حافظان صلح با موانع و محدودیت هایی مواجه است که از آن جمله می توان صلاحیت دیوان در رسیدگی به جرایم اشاره کرد، زیرا دیوان کیفری صلاحیت رسیدگی به همه جرایم حافظان صلح را ندارد و صلاحیت دیوان کیفری بین المللی محدود به مهمترین جرایم بین المللی مربوط به جامعه بشری است. همچنین مطابق بند دوم ماده 98 اساسنامه رم، برخی کشورها به معاهدات دو جانبه با دیگر دولت ها روی آورده اند. این نوع موافقت نامه ها که به " موافقت نامه های ماده 98" معروف هستند، در جلوگیری از تعقیب و تحقیق اتباع برخی دولت ها توسط دیوان کیفری بین المللی منجر شده است. علاوه بر آنها دیوان تنها می تواند نسبت به دولت های عضو اساسنامه اعمال صلاحیت نماید ولی در صورتی که وضعیت از سوی شورای امنیت به دیوان ارجاع شده است، رضایت هیچ دولتی اعم از عضو و غیر عضو شرط اعمال صلاحیت دیوان نیست.

United nation peacekeeping operation as subsidiary organs of the United Nations Security Council enjoys the privileges and immunity. In some peacekeeping operation there are reported violations of human rights and humanitarian right abuses committed by peacekeepers. But their immunity prevents them from prosecuting in court of host state and the only competent court to hear their crimes is national court of sending state as well as ICC. Though the immunity is not obstacle for ICC in prosecution peacekeepers, but there are some other Obstacles and limitations for ICC in prosecution of crime such as jurisdiction of the Court, because the court does not have jurisdiction to hear all crime and its jurisdiction is for the most serious crimes of international concern. And according Rome Statute of the International Criminal Court article 98(2) some states have bilateral agreement. This agreement calls “Article 98 agreements “which prevent some state national from ICC prosecution. In addition the ICC can prosecute member of the Rome Statute but if the cases were sent from security council of UN the consent of any state, whether member or non-member, in not condition for ICC jurisdiction.
