چکیده

این نوشتار با شیوه توصیفی تحلیلی کاربرد ومصادیق عرف در عبادیات(وضو، تیمم، صلاة وحج) مورد بررسی قرار داده است. عرف کارایی گسترده ای در فقه دارد، این امر بخوبی در کتابهای فقهی از باب طهارت تا دیات مشهود است، برخی از دانشمندان بخصوص اصولیین اهل تسنن آنرا به عنوان یک منبع ودلیل استنباط احکام در کنار کتاب، سنت ، عقل واجماع دانسته اندکه کارایی استقلالی برای عرف قائل شده اند،برخی دیگر با مرجعیت دانستن عرف مخالفت کرده اند وبه کارایی ابزاری آن معتقدند بعنوان وسیله ای در خدمت سایر ادله. نظام های فقهی حقوقی اسلام در محیط عرف شکل گرفته، هرچند منشأ ومبنای اعتبار قوانین اراده ی شارع دانسته شده است، در بسیاری موارد شارع قواعد وقراردادهای عرفی را امضا وتأیید یا تعدیل وتکمیل نموده است، لذا کاربرد ونقش عرف در نظام حقوقی اسلام در مقام تطبیق واجرای قواعد ارزنده است، وبه نظر بعضی کاربرد عرف در مقام استنباط احکام دارای اهمیت بسزایی است. در این پژوهش مصادیق عرفی در وضو، تیمم،صلاة وحج به طور مفصل بیان شده است.

چکیده [English]

This essay examines the application of customary practices in worship (ablution, tymim, salah al-waqi) in a descriptive-analytic manner. Tradition is widely practiced in jurisprudence, and this is well-known in jurisprudence books from Purgatory to Diet; Others have opposed the authority of custom, believing in its instrumental utility as a tool to serve other arguments. Islamic jurisprudential legal systems have been formed in the customary environment, although recognized as the source and basis of the validity of the laws of the will of the law, in many cases the law has signed or endorsed customary laws and regulations, thus applying customary law in the Islamic legal system. Implementing the rules is valuable, and in some cases the application of custom is very important when inferring sentences.
