چکیده

فورم شاپینگ اصطلاحی است که در نظام حقوق عرفی یا کامن لا عبارتی نام آشناست؛ لیکن این واژه ترکیبی، در نظام حقوق مدون، مفهومی جدید است که در خصوص تقلّب نسبت به صلاحیت دادگاهها بکار می رود. امروزه تقلّب چه نسبت به قانون و چه نسبت به انتخاب صلاحیت دادگاه با قصد ایذاء خوانده و کسب منافع خواهان؛ از زمره مواردی است که نگرانی هایی را در روابط خصوصی افراد در عرصه بین الملل ایجاد نموده است. در این مقاله به شناخت مفهوم فورم شاپینگ از حیث حقوق بین الملل خصوصی پرداخته شده که از موانع اجرای قانون خارجی در سنّت کامن لا بحساب می آید و از آنجا که این مسئله در نظام حقوقی ایران و حقوق مدون، قاعده سازی نشده است؛ جای بحث و بررسی را باقی می گذارد و به مثابه آن، راهکارهایی را برای جلوگیری از تحقّق و ارتکاب این نوع تقلّب در نظام حقوقی ایران ارائه می دهد.

چکیده [English]

It is highly evident that ',Forum shopping is a critical term in the common law system; nonetheless, such a term is a new concept in the Roman Germanic law used in the case of fraud in relation to the jurisdiction of the courts. Nowadays,, fraud, whether in relation to the law or in regards to the choice of court jurisdiction, with the intention of harming the defendant and attaining the interests of the plaintiff; It is one of the cases for sure caused deep concerns in the private relations of people in the international level. In this article, the concept of common law regarding forum shopping is debated in terms of private international law, viewed as one of the difficulties to the implementation of foreign law in the common law precedent, since this matter of importance never be regulated in Iran's legal system and codified law; therefore this article suggested some ways to prevent its occurring.
