چکیده

غیرنظامیان، زنان و کودکان ،اسیران جنگی، مجروحین و..به طور کلی قاعده مند کردن مخاصمات مسلحانه می باشد. از این منظر جنگ یک عمل اجتناب ناپذیر است، اما آثار و تبعات جنگ را بر گروه های مورد حمایت می توان کاهش داد.قربانی شدن افراد غیرنظامی در مناطق نظامی و سیاسی کشورها اساسی‌ترین و بدیهی‌ترین حقوق آنها یعنی حق حیات آنها را نقض می‌کند غیر انسانی بودن کشتار ها آنقدر از اثبات آن ها و اسناد استراد به ماهیت حقوقی بین المللی با این حال یادآوری معادلات بین‌المللی دولت های درگیر مخاصمات مسلحانه وجدان ناهوشیاری جنگ‌طلبانه سرمست قدرت را به چالش خواهد کشید کنوانسیون ها و پروتکل‌های ژنو به منظور محاکمه عادلانه افراد مورد حمایت و جلوگیری از اجرایی خودسرانه حقوق افراد غیر نظامی و یا ارتکاب رفتارهای غیر انسانی ضمانت‌های قضایی گسترده پیش بینی می نمایند.
حق جبران خسارت ، حق رفتار با احترام، حق حمایت و حق درخواست غرامت از جمله حقوقی است که در اسناد بین المللی و منطقه ای برای قربانیان نقض های شدید حقوق بشر و حقوق بشر دوستانه بین المللی به رسمیت شناخته شده است.
جنایات گروه های تروریستی با حمایت اسرائیل آمریکا به افراد غیر نظامی درکشورهای مسلمان از موارد نقض و تعرض به حقوق بنیادین افراد غیر نظامی از جمله حق حیات حق من شکنجه و سایر حقوق است نهادهای حقوق بشری در قبال نقض و تعرض به حقوق های افراد غیر نظامی موضع گیری موثر و شفاف انجام نداده اند.در این مقاله به بررسی وضعیت حقوق غیر نظامیان در مخاصمات مسلحانه خواهیم پرداخت.

چکیده [English]

Civilians, women and children, prisoners of war, injured, etc. are generally regulating armed conflicts. From this point of view, war is an inevitable act, but the effects and consequences of war on support groups can be reduced. The kindness of civilians in the military and political areas of countries violates their most fundamental and obvious rights, the inhumane right to live. The slaughter is so proven by them and the documents of the international legal nature, however, reminding the international equations of governments involved in armed conflict of war -based conscience will challenge the conventions and protocols of Geneva in order Preventing arbitrary enforcement of civilian rights or committing inhumane behaviors predicts extensive judicial guarantees.
The right to compensation, the right to conduct, the right to protection, and the right to claim compensation are among the rights recognized in international and regional documents for victims of severe human rights violations and international humanitarian rights.
The crimes of Israeli -backed terrorist groups to civilians in Muslim countries are violating and violating the fundamental rights of civilians, including the right to torture and other rights, human rights institutions in violation of the rights of civilians. In this article we will examine the status of civilian rights in armed conflicts.
