چکیده

در غیاب قانون منسجم و نوشته در کشورهای اسلامی، قواعد فقه مبنای قضاوت بوده است و فقها و قضات ناگزیر از مراجعه به این قواعد بوده اند که در هر کدام از مذاهب اسلامی به شیوه و سیاق خاصی تدوین شده است این مقاله به بررسی سیر تدوین قواعد فقه که حاصل اندیشه و پژوهش فقهی فقها در مذاهب اسلامی پرداخته است. در ابتدا به تعریف قواعد فقه و سپس منابع این قواعد اشاره شده است با توجه به قدمت تالیفات در مذاهب اهل سنت ابتدا سیر تطور آن در مذهب حنفیه و سپس سایر مذاهب اهل سنت ازجمله مالکی و حنبلی و شافعی پرداخته و آن گاه به مذهب امامیه می پردازیم و در هر کدام از این مذاهب به ترتیب تقدم، تالیفات مرتبط ذکر خواهد شد سپس ضمن بررسی مجلة الاحکام و تاثیرات آن بر کشورهای اسلامی و عربی و بررسی شرح های آن در پایان نگاهی گذرا به قواعد حاکم بر کشورهای اسلامی در زمان حاکمیت عثمانی و پس از استقلال خواهیم داشت و تصنیفات جدید را در این زمینه، حتی الامکان به همراه شرح مختصری از کتاب مزبور معرفی می نمائیم.

چکیده [English]

In the absence of a coherent and written law in Islamic countries, the rules of jurisprudence have been the basis of judgment.The jurisprudents and judges have had to refer to these rules, which have been developed in any of the Islamic religions in a particular way. This article examines the process of compilation of the rules of jurisprudence, which is the result of the jurisprudential thought and research of the jurisprudents in Islamic religions. In the beginning, the rules of jurisprudence are defined and then the sources of these rules are mentioned. Due to the age of writings in Sunni religions, the evolution of it first begins in the religion of Hanafi and then other Sunni religions, and then into the Imam's religion. Due to the age of writings in the Sunni religions, the evolution of the Hanafi religion first begins, then the other Sunni religions and then the Imāmī religion. By reviewing the “Al-Ah’kaam” magazine and its descriptions, in the end, we will have a quick look at the rules governing the Islamic countries during the Ottoman rule and after independence. We introduce the new writing with a brief description of the book.
