چکیده

با توجه به تحولات پر اهمیت اقتصادی در سطوح منطقه ای و بین المللی و توجه خاص سایر کشورها به برقراری ارتباطات اقتصادی وتجاری با یکدیگر و با توجه به حجم عظیم فعالیت ها و کنترل و هدایت نیروهای متخصص آنها در ایجاد و برقراری ارتباطات تجاری – اقتصادی، لازم است به مسائل حقوقی اقتصادی توجهات ویژه صورت گیرد. مقتضیات مکان و زمان و بحران های اقتصادی در جهان امروز نیازهای خاص اقتصادی را می طلبد که باید نیروهای داخلی ضمن اطلاع از این قوانین و ضوابط، نقاط آسیب پذیری را شناسایی کرده و به حل و فصل مسائل اقتصادی شان با سایر دول بپردازند. تضاد های حقوقی سرمایه گذاری ها و اثرات آن همراه عدم حمایت های عمومی در مواردی سبب عدم کارایی گسترده شده است. همچنین اثرات سرمایه گذاری های بخش خصوصی در توسعه کشورهای میزبان و اثرات سرمایه گذاری ها در حمایت از بخش های عمومی کشور میزبان در موارد بسیاری نادیده گرفته شده است. هر زمان حمایت های سرمایه گذاری هدف اولیه در حقوق تجارت بین المللی سرمایه گذاری خارجی بوده است، اصل استقلال هر کشوربا اثرات خاص نسبت به کشور میزبان، به طور شدیدی حقوق کشور میزبان بدون مزیت را در سرزمین های خارجی محدود میکند، فلذا اهمیت بررسی این موضوع روشن میگردد. این مقاله ضمن تشریح و تبیین اهمیت و الزامات خاص موضوع، به بررسی نمونه ها و ضرورت و اهمیت آنها در عرصه تحولات جدید بین المللی می پردازد.

چکیده [English]

It is necessary to pay special attention to economic legal issues due to the significant economic developments at the regional and international levels and the special attention of other countries to establish economic and trade relations with each other and to the huge volume of activities and control and guidance of their specialized forces and establishing and establishing trade-economic relations.
