چکیده

از مهمترین مضامین در علوم اسلامی و علوم انسانی، فهم دقیق معنای متن است. هرمنوتیک از شاخه های علوم انسانی است که به بح‍‍ث در مبانی نظری تفسیر و فهم متن می‌پردازد. علم اصول فقه نیز هدف مشابهی را دنبال می‌کند. زیرا وظیفه‌ی آن، استنباط حکم شرعی از متون و منابع دینی است و از این روست که اصولیان در بحث الفاظ ناگزیر به کشف قواعد فهم متون هستند. فقیه در استنباط احکام از متن کتاب و سنت، یعنی قرآن و احادیث اسلامی استفاده می کند، و ضرورت استفاده از این متون باعث شده است که حدود نیمی از مباحث اصول فقه مصروف بیان قواعدی شود که راهنمای چگونگی بهره‏گیری از الفاظ کتاب و سنت در استنباط احکام هستند. این بخش را «مباحث الفاظ » نامیده‏اند، و از اینجاست که بحث رابطه این بخش از اصول فقه با هرمنوتیک معاصر به میان می‏آید و ضابطه تفهیم و تفهم میان گوینده و مخاطبی که با یکدیگر هم‏افق نیستند، مطرح می شود.
در منابع اصولی معمولاً چند نظریه در مسأله فهم دقیق معنای متن ذکر می شود که نشان از پدیدار شناسی مساله هرمنوتیک قبل از مطرح شدن آن توسط شلایر ماخر متکلم و ادیب آلمانی در قالب نظریات اصولی دارد که اهمّ آنها شامل: نظریه مصداقی معنا، نظریه تصوری معنا، نظریه طبیعی معنا، نظریه حکایی معنا، ماهیت معنا می‌باشند. در این پژوهش که به شیوه توصیفی-تحلیلی همراه با گردآوری اطلاعات اسنادی و کتابخانه‌ای انجام می گیرد،‌ به بررسی مبانی مشترک میان اصول فقه و هرمنوتیک کلاسیک پرداخته شده است

چکیده [English]

One of the most important topics in Islamic sciences and humanities is accurate understanding of the meaning of the text. Hermeneutics is a branch of the humanities that discusses the theoretical foundations of text interpretation and comprehension. The science of the principles of jurisprudence pursues a similar goal. Because its duty is to deduce the Shari'a ruling from religious texts and sources. And that is why the fundamentalists in the discussion of words are forced to discover the rules of understanding texts.
The jurist uses the text of the book and tradition, ie the Qur'an and Islamic hadiths, to deduce the rulings, and the necessity of using these texts has caused about half of the discussions on the principles of jurisprudence to be used to express rules that guide how to use the words of the book and tradition. They are in inferring the rulings This section has been called "discussion of words", and this is where the discussion of the relationship between this section of the principles of jurisprudence and contemporary hermeneutics arises and the criterion of understanding between the speaker and the audience that are not on the same horizon is raised
