چکیده

یکی از جرائم مهمی که در تمام دنیا جرم انگاری شده است و نوع بشر در مقابل با آن واکنش نشان داده است، توهین و استخفاف سایر افراد است. از طرفی با توجه به روابط بین المللی جوامع با یکدیگر و افزایش روزافزون آن در سطح اجتماعی و سیاسی؛ اطلاع یافتن نسبت به یافته های حقوقی سایر کشورها از جهات مختلفی اهمیت پیدا میکند. به همین دلیل در این مقاله با مطالعه تطبیقی بین جرم توهین - به معنای اعم آن - بین کشور ایران و عراق، سعی شده است تا وجوه تمایز احصا شود و همچنین رویکردهای نوین قانونی و احیاناً کاستی هایی که موجب افزایش جرم و ظهور بی قانونی میشوند، نیز بررسی گردد. با مطالعه دقیق، میتوان گفت: قوانین کیفری ایران رویکرد نزدیک تری به احکام شریعت مقدس اسلامی دارند ولی این به معنای کامل بودن قوانین در این حوزه نمیباشد و با بررسی قوانین کیفری عراق به این مهم دست یافتیم که در موضوعاتی مانند موارد اباحه توهین ، قانونگذار ایران نیز مانند عراق، میتواند رویکرد دقیق تری را پیش بگیرد که هم متناسب با شریعت مقدس اسلامی باشد و هم از عوامل جزم زدا و کاهش بزه کاری به شمار رود و در فرایند پیشگیری از جرم نیز مؤثر واقع شود.

One of the most important crimes that has been criminalized all over the world and against which humanity has reacted is insulting and denigrating other people. On the other hand, considering the international relations of societies with each other and its increasing level at the social and political level; Knowing the legal findings of other countries is important in many ways. For this reason, in this article, by comparative study between the crime of insult - in the general sense - between Iran and Iraq, an attempt has been made to count the differences, as well as new legal approaches and possibly shortcomings that increase crime and the emergence of lawlessness. , Also be checked. With a careful study, it can be said: Iranian criminal law has a closer approach to the rules of the holy Islamic law, but this does not mean that the laws in this area are complete, and by examining the Iraqi criminal law, we reached the important point that in matters such as insults, legislators Iran, like Iraq, can take a more precise approach that is both in line with the holy Islamic law and as a deterrent to reducing crime and being effective in the crime prevention process.
