چکیده

امروزه جایگاه و اهمیت شرکتهای تجاری در سرمایه گذاری و تحول اقتصادی برکسی پوشیده نیست و به نوعی شرکتها گرداننده اقتصاد جهانی محسوب می شوند. در همین راستا مهیا نمودن فضای فعالیت این شرکتها اعم از تشکیل و ثبت آنها، صدور مجوز و ارائه تسهیلات مختلف می تواند به بهبود فضای کسب و کار و در نهایت توسعه اقتصادی منجر شود. مسائل ثبتی شرکتها یکی از پارامترهای مهم مرتبط با فضای کسب و کار است در این میان امکان تبدیل شرکتهای تجاری به انواع مختلف می تواند در تسهیل فعالیت آنها مثمرثمر واقع گردد. هر چند در قانون تجارت امکان تبدیل بعضی از انواع شرکتها پیش بینی شده است اما جهت بهبود وضعیت کسب و کار و تسهیل فعالیت های اقتصادی و براساس دستورالعمل تبدیل شرکتها امکان تبدیل انواع شرکتها میسر شده است. مقاله پیش رو در تلاش است تا با روشی توصیفی و تحلیلی و با استفاده از منابع کتابخانه ای و اینترنتی موجود، ضمن تبیین مفهوم تبدیل و شرایط آن و برشمردن فرصت ها و چالشهای این نهاد حقوقی، رویه عملی ادارات ثبت شرکتها و موسسات غیرتجاری را در این رابطه مورد بحث و بررسی قرار دهد.

Today, the position and importance of commercial companies in Brexit investment and economic transformation is not hidden, and in a way, companies are considered as the drivers of the global economy. In this regard, providing the business environment of these companies, including their formation and registration, licensing and providing various facilities can improve the business environment and ultimately economic development. Corporate registration issues are one of the important parameters related to the business environment. Among these, the possibility of transforming commercial companies into different types can be effective in facilitating their activities. Although the commercial law provides for the possibility of converting some types of companies, but in order to improve the business situation and facilitate economic activities, and based on the instructions for converting companies, it is possible to convert different types of companies. The present article tries to explain the concept of conversion and its conditions and enumerate the opportunities and challenges of this legal entity in a descriptive and analytical way and using the available library and internet resources. Discuss this relationship.
