چکیده
امروزه بخش قابل توجهی از دعاوی مطروحه در دستگاه قضایی، دعاوی مربوط به حقوق تجارت است و یکی از حوزه‌های دادرسی که به دلیل پیچیدگی موضوعات، عناوین و دعاوی نیاز مبرم به دادگاه‌های اختصاصی دارد حوزه تجارت می‌باشد، زیرا ماهیت امور و دعاوی تجاری، سرعت و دقت فراوان در رسیدگی را می‌طلبد. در این راستا دادگاه‌های تجاری از مهم‌ترین دادگاه‌های اختصاصی در هر نظام حقوقی به شمار می‌روند که توسعه امور و فعالیت‌های تجاری، تسهیل سرمایه‌گذاری و بهبود شاخص‌های اقتصادی جوامع، نشان از نقش انکارناپذیری این دادگاه‌ها دارد. در کشور ایران محاکم اختصاصی تحت عنوان دادگاه‌های تجاری وجود ندارد. لیکن در حقوق فرانسه این دادگاه‌ها نقش مؤثری دارند، به طوری که تجار و نمایندگان تجار اعضای اصلی این دادگاه‌ها را تشکیل می‌دهند. همچنین در حقوق انگلستان این دادگاه‌ها، تخصصی است و رسیدگی در آن به طور خاص انجام می‌گیرد، به طوری که شامل موارد پیچیده ناشی از اختلافات تجار در سطح ملی و بین‌المللی می‌باشند و به موضوعاتی از جمله تجارت بین‌المللی، بانکداری و اختلافات داوری تأکید خاص دارند. بر این اساس، تدوین و تصویب مقرراتی جامع و منسجم در خصوص رسیدگی به امور و دعاوی تجاری و تشکیل دادگاه‌های تجاری به نحوی که در نظام حقوقی فرانسه و انگلستان وجود دارد، همواره از دغدغه‌های نظام حقوقی ایران بوده است. لذا در این مقاله جایگاه دادگاه‌های تجاری در حقوق ایران، فرانسه و انگلستان مورد بررسی قرار می‌گیرد.

Today, a significant part of litigation in the judiciary is litigation related to commercial law, and one of the areas of litigation that is in urgent need of specialized courts due to the complexity of cases, titles and lawsuits is the field of business, because the nature of business and litigation, speed and Requires great care in handling. In this regard, commercial courts are one of the most important specialized courts in any legal system that the development of business and activities, facilitating investment and improving the economic indicators of societies, shows the undeniable role of these courts. There are no special courts in Iran called commercial courts. However, in French law, these courts play an important role, as merchants and business representatives are the main members of these courts. These courts are also specialized in English law and deal with them in a special way, covering complex cases arising from national and international business disputes, with particular emphasis on issues such as international trade, banking and arbitration disputes. . Accordingly, the development and adoption of comprehensive and coherent regulations regarding the handling of commercial cases and lawsuits and the establishment of commercial courts in the way that exists in the French and British legal systems, has always been a concern of the Iranian legal system. Therefore, in this article, the position of commercial courts in the law of Iran, France and the United Kingdom is examined.
