چکیده

ازدواج در سنین کودکی پدیده‌ای شوم و ناگوار است که از طرفی کودک را از چشیدن طعم شیرین کودکی محروم کرده و از سوی دیگر زمینه بروز آسیب‌های اجتماعی و فردی متعدد را پدید می‏آورد. کودک همسری افزون بر آثار نامطلوب فردی و اجتماعی؛ محتمل است که منجر به بروز جرایم مختلف خانوادگی، قتل‌های ناموسی، سوء استفاده جنسی و معذالک گردد که بر این اساس، ضرورت براین است تا قانونگذار در جهت رفع این بحران، اقدامات مقتضی را انجام دهد. اقدامات متعددی در جهت زدودن کودک همسری، در قوانین جمهوری اسلامی ایران، ایضاً در رویه‌های بین‌المللی، صورت پذیرفته؛ لکن طرح این اقدامات، تاکنون نتیجه مطلوبی به همراه نداشته است.
تحلیل متغیرهای جمعیت شناختی حکایت از آن دارد که براساس آمار رسمی، ۵ درصد ازدواج‌های کشور در سن پایین رخ داده و عمده آ‌ن‌ها در بازه سنی ۱۰ تا ۱۴ سال بوده و در همه استان‌های کشور نیز مشاهده شده است. براساس نتایج حاصله از این بررسی، پیرامون پیامدها و آثار موضوع از جهات: میزان طلاق، ترک تحصیل، بارداری و مرگ و میر کودکان و مادران، رضایت جنسی، خشونت خانگی، وضعیت گروه سنی یاد شده، نسبت به سایر گروه‌های سنی غیر عادی و بعضاً بحرانی است. جهت برون رفت از این بحران، پیشنهاداتی نظیر تغییر قوانین در راستای، ممنوعیت مطلق ازدواج با دختری که به بلوغ جنسی نرسیده و جرم انگاری ممانعت از تحصیل دختران متأهل در مدارس در این پژوهش ارائه شده است.

Childhood marriage is a sinister and unfortunate phenomenon that on the one hand deprives the child of the taste of the sweet taste of childhood and on the other hand creates the ground for numerous social and personal harms. In addition to adverse individual and social effects, the spouse child can cause various family crimes; Honor killings, sexual abuse, etc., on the basis of which it is necessary for the legislator to take action to resolve this crisis. In our country's law as well as in international procedures, several measures have been taken to eradicate this ominous phenomenon; Moreover, the measures taken so far have not been able to bring the desired result and according to the statistics of the Statistics Center of Iran, the number of child marriages per year is recorded in Iran. Attempts have been made to describe the depth of the crisis and ultimately to provide a solution for the adoption of the desired policy in this regard
