چکیده

مدیریت ریسک احتمال وقوع قصورات و خطاهای کادر درمان یکی از مسائل حائز اهمیت در حوزه‌ی ارائه‌ی خدمات درمانی است. در این خصوص اگرچه مدیریت پسینی قصوراتی که منجر به صدمات جسمانی، نقصان منفعت و یا فوت بیماران می‌شوند‌‌ جهت جبران کامل خسارات وارد شده بر بیمار لازم می‌باشد، لیکن صرف اعمال مجازات‌های کیفری بر فردی که ارتکاب تقصیر از جانب وی منجر به ورود جنایات شبه عمد بر مددجو گردیده است، منتج به مدیریت کارآمد ریسک حدوث مجدد خطاهای کادر درمان نمی‌شود. لذا علاوه بر مدیریت پسینی خطاهای واقع شده، مدیریت پیشگیرانه‌ و شناسایی عوامل مؤثر در بروز قصورات کادر درمان و ارائه روش‌های کاربردی جهت جلوگیری از تکرار آن‌‌ها از اهمیت بسزایی برخوردار است.
بر این اساس در این مقاله تلاش نمودیم با بهره جستن از رهیافت‌های موجود در جرم‌شناسی پیشگیرانه، به تبیین رایج‌ترین علل و عوامل مولد خطاهای کیفری کادر درمان بپردازیم و به تبع آن راهکار‌های مقتضی در راستای پیشگیری از وقوع قصورات و خطاهای کادر درمان را ارائه نمایییم. از جمله این راهکارها عبارت اند از: ارائه مشوق‌های قانونی درخصوص اعمال تخفیف در میزان مجازات افرادی که خطای خود را ابراز نموده اند جهت ایجاد نظام گزارش‌دهی خطاهای درمانی، ارائه خدمات درمانی رایگان توسط فرد خاطی به همراه درج شرط کاهش مدت زمان ارائه خدمات رایگان درصورت عدم ارتکاب تقصیر در طول مدت ارائه خدمات رایگان، استقرار واحد بازرسی مستقل در هر بیمارستان که امکان گزارش و اطلاع از نارضایتی بیماران و کشف موارد حدوث قصورات کادر درمان و زمینه‌‌ی کاهش آن‌ها را فراهم می‌آورد.

چکیده [English]

Risk management of the medical violations and negligence is one the important issues in the field of providing medical services. Although solution management of negligence that amount to physical injuries, loss of benefit or death of patients is necessary for full compensation of patient’s damages, but applying criminal penalties to the person whose fault has led to quasi intentional crimes does not lead to efficient management of the risk of medical errors recurrence. Therefore, in addition to solution management of deficiencies, prevention management and recognition of effective factors in the incident of medical staff’s errors and providing practical methods to prevent them is very important.
In this article we tried to explain the most common causes of treatment staff’s criminal medical negligence by using the existing approaches in preventive criminology and provide appropriate solutions in order to prevent the occurrence of these failures. Among these solutions are: Providing legal incentive regarding reducing the amount of punishment for those who have expressed their mistakes which will lead to the creation of an error reporting system, Providing free medical services by the guilty person with the condition of reducing the period of providing free services if no fault is committed during that period, establishing an independent inspection unit in each hospital which provides the possibility of reporting and informing about the dissatisfaction of the patients.
