چکیده

مقاله حاضر با عنوان "دیدگاه شیخ انصاری و آخوند خراسانی در مورد کلمه "لا" در قاعده لاضرر" است که به بررسی نظرات این دو اندیشمند درباره قاعده لاضرر و تفسیر آنان از کلمه "لا" می‌پردازد. در اینجا، تلاش شده است تا به سوالاتی که درباره تبیین قاعده لاضرر توسط شیخ انصاری و آخوند خراسانی مطرح می‌شود، پاسخ داده شود. برای این منظور، آثار فقهی و اصولی شیخ انصاری و آخوند خراسانی و نظرات آنها مورد توجه قرار گرفته است. در ابتدا، مفاهیم و تعریف قاعده لاضرر با تأکید بر رویکرد شیخ اعظم و آخوند خراسانی بررسی شده است. سپس، دیدگاههای شیخ انصاری و آخوند درباره کلمه "لا" در ابتدای قاعده لاضرر مورد بحث قرار گرفته و تشابه‌ها و تفاوت‌های آنها بیان شده است. در نهایت، با اثبات ارجحیت و برتری دیدگاه شیخ انصاری نسبت به دیدگاه آخوند، برداشت و گستره کاربرد قاعده لاضرر از منظر شیخ اعظم و آخوند مورد بررسی و نقد قرار گرفته است. به‌طور خلاصه، این پژوهش به تبیین دیدگاه‌ها و نظرات شیخ انصاری و آخوند خراسانی درباره قاعده لاضرر و تفسیر کلمه "لا" پرداخته و به بررسی و نقد آنها پرداخته است.

چکیده [English]

The present article is entitled "The views of Sheikh Ansari and Akhund Khorasani on the word "la" in the rule of the prohibition of detriment " which examines the opinions of these two thinkers about the rule of rule of the prohibition of detriment and their interpretation of the word "la". Here, an attempt has been made to answer the questions raised by Sheikh Ansari and Akhund Khorasani about the explanation of the rule of the prohibition of detriment. For this purpose, the jurisprudential and principled works of Sheikh Ansari and Akhund Khorasani and their opinions have been taken into consideration. At first, the concepts and definition of rule of the prohibition of detriment have been examined with emphasis on the approach of Sheikh ansari and Akhund Khorasani. Then, the views of Sheikh Ansari and Akhund about the word "la" at the beginning of the rule of the prohibition of detriment are discussed and their similarities and differences are stated. Finally, by proving the superiority and superiority of Sheikh Ansari's point of view over the akhunds point of view, the perception and scope of the application of the Harm Rule has been examined and criticized from the perspective of Sheikh Azam and the akhund. In short, this research explained the views and opinions of Sheikh Ansari and Akhund Khorasani about the rule of the prohibition of detriment and the interpretation of the word "la" and reviewed and criticized them.
